The individual named below (“I” or “me”) desires to voluntarily participate in an activity at the Allstate Arena (“Activity”) provided by Rosemont Hockey Partners, L.P. d/b/a Chicago Wolves (“Company”). In consideration of being permitted by the Company to participate in the Activity and in recognition of the Company’s reliance hereon, I agree to all of the terms and conditions set forth herein (“Release”). This Release applies to my participation in the Activity and in all related events, all preparatory or concluding tasks, and any use of facilities or equipment in connection therewith.
I am in good health and fully capable of participating in the Activity. I know the nature of the Activity and the range of my experience and capabilities and believe myself to be qualified to participate in the Activity. IF I BELIEVE ANYTHING IS UNSAFE, I WILL IMMEDIATELY ADVISE A MEMBER OF THE COMPANY OF SUCH CONDITION(S) AND REFUSE TO PARTICIPATE FURTHER IN THE ACTIVITY.
I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, AND/OR DEATH. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY (INCLUDING NEGLIGENT EMERGENCY RESPONSE OF THE COMPANY), OF THIRD PARTIES, OR OF OTHER PARTICIPANTS IN THE ACTIVITY, OR THE CONDITION AND LAYOUT OF THE PREMISES OR EQUIPMENT. FURTHER, THERE MAY BE OTHER RISKS NOT KNOWN TO ME OR THAT ARE NOT READILY FORESEEABLE AT THIS TIME. NOTWITHSTANDING THE FOREGOING, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE NATURE OF THE ACTIVITY (INCLUDING ANY INHERENT DANGER IN THE ACTIVITY) AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, PAIN, SUFFERING, DISABILITY, OR DEATH ARISING FROM MY PARTICIPATION IN THE ACTIVITY, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE ACTS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY OR ANY RELEASEES.
I hereby expressly waive, discharge, and release any and all claims, demands, losses, or damages now known or hereafter known, against the Company, and its affiliates and affiliated clubs, their respective owners, partners, and administrators, officers, directors, manager, employees, agents, coaches, other participants, sponsoring agencies, sponsors, advertisers, successors, and assigns (collectively, “Releasees”), from all liability to me, my assigns, heirs, or kin for any injury, disability, death, or property damage arising out of, related to, or attributable to the Activity, whether arising out of the negligence of the Company or any Releasees or otherwise. I hereby covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims.
I shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by or awarded against the Company or any other Releasees arising out of or resulting from any claim I make or of a third party related to my participation in the Activity, including any claim related to my own negligence, acts, or omissions. This indemnification obligation is intended to be as broad and inclusive as permitted by Illinois law.
I understand that I may be filmed, photographed, or videotaped during the Activity and hereby consent for my likeness to appear in such filmed, photographed, or videotaped record, whether in print, electronic media or social media, and in consideration of the Company’s permitting me to participate in the Activity, irrevocably grant the Company and its affiliates the unrestricted, perpetual, worldwide right to use my name, image, likeness, voice, and biographical information in any media now known or later developed, for any lawful purpose, including advertising, promotion, or marketing, without compensation, notice, or further consent.
This Release constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Illinois without giving effect to any choice or conflict of law provision or rule (whether of the State of Illinois or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Cook County, Illinois and I hereby consent to the exclusive jurisdiction of such courts.
ACKNOWLEDGMENT OF UNDERSTANDING: I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE, AND I SIGN IT FREELY AND VOLUNTARILY.
BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS CONSENT, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF THE RISK, AND INDEMNITY AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY TO RECOVER DAMAGES FOR LOSSES OCCASIONED BY THE COMPANY OR RELEASEES FAULT, AND SIGN IT VOLUNTARILY WITHOUT ANY INDUCEMENT OF ANY NATURE AND INTEND FOR IT TO BE ENFORCED TO THE GREATEST EXTENT ALLOWED BY LAW. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT.
